These Terms of Service (“Terms”) govern your use of https://www.everstonesurface.com (the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About Our Services

Everstone Surface Solutions Inc. (“Everstone,” “we,” “us,” “our”) provides residential and commercial surface restoration, sealing, and protection services for concrete, pavers, natural stone, brick, and exterior hardscapes throughout Southwest Washington and the Portland metropolitan area. We carry general liability insurance and workers’ compensation insurance. Proof of insurance is available on request.

2. Website Use

You may use the Site only for lawful purposes. You agree not to:

Submit false or misleading information through our forms
Scrape, copy, or republish Site content without written permission
Attempt to interfere with the Site’s security or operation
Use the Site to transmit spam, malware, or automated queries

3. Estimates and Quotes Are Not Contracts

Any pricing, estimate, or quote provided through the Site, by phone, by text, or by email is preliminary and non-binding. Final pricing is determined after an on-site assessment of the surface and is set out in a written contract signed by both parties. Surface restoration, sealing, and protection work, including any multi-year maintenance or protection program, is governed exclusively by that signed contract, not by these Terms. If there is a conflict between these Terms and a signed service contract, the service contract controls.

4. Scheduling and Communications

Submitting a form or requesting an estimate through the Site constitutes your request that we contact you by phone, email, or text at the contact information you provide, including through automated dialing systems where permitted. 5. Content Accuracy

We work to keep Site content (service descriptions, project photos, financing terms, promotional offers) accurate and current, but we do not guarantee it is error-free. Promotional offers are subject to their stated terms, availability, and expiration dates. Project photos represent past work on specific surfaces under specific conditions. Results vary with substrate type, age, porosity, prior coatings or sealers, staining, drainage, and exposure, and past results do not guarantee identical results on your property.

6. Intellectual Property

All Site content, including text, logos, photos, and graphics, is owned by Everstone Surface Solutions Inc. or its licensors and is protected by copyright and trademark law. You may not use it without our written permission.

7. Third-Party Links and Tools

The Site may include links to third-party sites and embedded third-party tools (maps, review widgets, financing applications, chat). We are not responsible for third-party content, services, or privacy practices.

8. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WARRANTIES ON SURFACE RESTORATION AND SEALING WORKMANSHIP AND ON MATERIALS ARE PROVIDED SEPARATELY IN YOUR SIGNED SERVICE CONTRACT AND IN ANY APPLICABLE SEALER OR COATING MANUFACTURER WARRANTY.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERSTONE SURFACE SOLUTIONS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY ARISING FROM USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). THIS SECTION DOES NOT LIMIT LIABILITY UNDER ANY SIGNED SERVICE CONTRACT OR ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

10. Indemnification

You agree to indemnify and hold harmless Everstone Surface Solutions Inc. and its owners, employees, and agents from claims arising out of your misuse of the Site or violation of these Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law rules. Any dispute arising from use of the Site will be resolved in the state or federal courts located in Clackamas County, Oregon.

12. Changes to These Terms

We may update these Terms at any time by posting a revised version with a new effective date. Continued use of the Site after changes means you accept the updated Terms.
